Whilst Anchors Away strives to deliver more convenient, customised services that meet your present and future needs, we also appreciate the uncertainty that comes with interacting in a constantly changing environment. We are sensitive to the concerns that our users may have with regards to the confidentiality, security and use of their personal information via our website, and would like to reassure you of our position on this matter.

We collect the e-mail addresses of those who communicate with us via e-mail and by information volunteered by our clients, such as survey information and/or site registrations. AABBC Terms and Conditions of Charter

The vessel will be made available for pick up from Airlie Beach and will be retuned on completion of the hire to Airlie Beach unless previous arrangements have been made with the hire company. Pick up or return at other locations such as Hamilton Island
The vessel will be delivered to the hirer in a clean, safe condition at the location described above. The vessel includes bedding, towels and an inventory of utensils detailed in an inventory list to be provided to the hirer on boarding. Fuel used will be charged at the prevailing pump price at Able Point Marina on the completion of the hire. In the case of the three cabin vessel there is an allowance of three hours per day generator running time to service refrigeration, hot water and battery charging and dishwashing. Running time in excess of this allowance will be charged at a rate of $6.00 per hour.
   

  • 1. It is agreed the hirer will perform a thorough inspection of the boat on arrival and identify any damage or shortfall of inventory items and shall satisfy themselves that all mechanical and electrical items perform as expected. On completion of the hire the company will perform a similar inspection and it is agreed that any damage or shortfall in inventory items, or any repairs needed to make mechanical or electrical items perform as expected other than fair wear and tear, will be paid for from the retention bond up to the sum of $2000. Any claim above this amount may be the subject of an insurance claim and the hirer indemnifies the company for any claims outside the scope of insurance for any acts of liability and all legal proceedings. Should an incident occur that threatens the whole of the bond but the vessel is capable of completing the charter a further bond shall be paid at that point or the charter terminated. The bond will be retained for ten days following completion of the hire.

  • 2. Should the vessel be unavailable as a result of mechanical failure, damage or any other cause beyond the control of the company for a period in excess of 24 continuous hours from the time the company is notified, or from the commencement of the hire period, the company can, at it's discretion (1) extend the charter at no cost to the hirer, (2) refund monies equal to the pro rata period that the boat was unavailable, (3) Replace the period in question with a charter at a later date. The company will not be liable for compensation for any lost time less than 24 continuous hours. Should the boat become unavailable due to negligent or inappropriate actions of the hirer the company has no liability in regard to compensation for time lost. Should the vessel become unavailable due to weather conditions requiring the vessel to return to port the company shall not be liable for time lost, it is recommended the hirer obtain travel insurance to protect against such an eventuality. The hirer agrees to return to a safe port or anchorage if instructed to do so by the company or its agents should weather or other circumstances threaten the safety of the boat and/or it's passengers. In the advent of a mechanical failure to redundant or non essential equipment on the vessel. It is at the discretion of the hire company to determine what measures if any are required to repair such equipment during the rental period

  • 3. The company, at it's absolute discretion shall be entitled to reclaim the vessel if the hirer conduct themselves in a manner that is in conflict with provisions of The Great Barrier Reef Marine Park Authority, the Department of Parks and Wildlife or in a manner that is likely to cause harm or damage to the vessel or to any other vessel or property or to any other third person. If the vessel is so reclaimed the hirer will have no claim for compensation for lost time or damages.

  • 4. This agreement is entered into on the condition that the boating experience stated by the hirer in the reservation form to be true and accurate in all respects. In the event of cancellation or premature termination of the charter by the hirer for any reason after acceptance by the company of the hire charges, no refund of monies will be made.

  • 5. The company shall not be liable for loss or damage to any personal items aboard the vessel and it is recommended the hirer take travel insurance for this purpose. The company does not take any responsibility for any injury or loss to any person aboard the vessel whether such injury or loss occurs on board the vessel or in any activity away from the vessel.

  • 6. The hirers agree to return the vessel to the location agreed upon at the time agreed upon. Should the vessel be left in a location other than that agreed upon, unless agreed to by the Company, they would be liable for the cost incurred by the company to recover the vessel. If the hirer is late returning the vessel they will be liable to a charge equal to the daily rate being paid by the hirer plus 50% for each day or part thereof that they are late.

  • 7. The company shall supply a thorough and complete briefing for all the hirers before handing over the boat. This briefing shall include complete instruction on the handling, operation and safety provisions of the boat. In addition a brief of the area in which the hirer may operate will be provided together with instruction on the operation of the radio and required radio check- in times. The hirer will be informed of all requirements and restrictions as may be imposed by The Great Barrier Reef Marine Park Authority or other statutory bodies from time to time and the hirer agrees to abide by these rules and restrictions.

  • 8. The company shall supply a "Hirers Manual" that shall contain all the information given during the briefing which the hirers agree to keep handy at all times and to refer to it as required. The company shall also provide a chart, which will clearly show the boundaries in which the hirer may operate the boat. It is understood that should the hirer take the vessel beyond these boundaries ALL INSURANCE PROVISIONS ARE CANCELED and the hirer will be personally liable for any damage or loss.

  • 9. It is agreed that should the hirer request emergency assistance on the water that is not the result of a mechanical failure due to fair wear and tear that the cost of such assistance will be charged for at the prevailing rates

  • 10. It is agreed the hirer will not attempt to enter a mooring pen or approach a wharf or any other fixed object nor raft up to another vessel without the express permission of the company in writing. Exceptions to this is Hamilton Island Marina,. At these places the hirer is permitted to approach a marina arm providing there are personnel from the marina to assist in docking and that the hirer is responsible for all damage to the vessel or any other boat or property. On the completion of the hire the hirer shall anchor outside the marina area and contact the company by radio to arrange the return of the vessel.

  • 11. The hirers are prohibited from jumping from the top deck of the boat at any time. The hirer is prohibited from throwing any objects overboard that could cause injury or pollute the environment and indemnifies the company against any claim arising from such acts by the hirer.

  • 12. It is agreed the vessel MUST be anchored for the night by 4.00pm. The hirers agree to contact the company by radio at this time and to supply such information concerning their location and anchor details as maybe requested by the company to ensure the safety of the hirer. Should the hirers be un-contactable a safety search may be undertaken with the costs charged to the hirer.

  • 13. The hirer shall satisfy itself regarding weather conditions and agrees that the company shall not be responsible for any incident resulting out of the hirer's inability to steer or manoeuvre the vessel.

  • 14. The hirers agree not to leave the vessel unattended at night unless secured to a proper mooring nor permit more than the licensed number of people (--) to be on board nor assign or let or part with possession of the vessel or any part thereof and will keep the vessel secure at all times.

  • 15. It is agreed the hirer will pay for all fuel used which will be to the hirers account and is not included I the hire cost. The vessel will be filled prior to departure and refilled on return, the cost of the fuel used may be deducted from the bond or if insufficient funds are available from the bond then the hirer agrees that his credit card may be debited by the company, if this facility is not available then the amount will be paid by cash or cheque.

  • 16. Whenever the term hirers appear in this agreement it is understood the term applies to each and every person in the party and that the hirer signing this agreement does so on behalf of all members of his party.

  • 17. The hirers will be responsible for any fines or penalties imposed by any government or private institution relating to the unauthorised discharge of waste or prohibited contaminants from the vessel.
